(Adnkronos) – The first hearing for the appeal filed by CNN, Ms Now, and Politico against Donald Trump’s ban prohibiting journalists from these outlets from accessing the White House has been set for tomorrow. The appeal, filed yesterday after the White House access badges of correspondents from these outlets were revoked on Saturday, asks the judge to immediately issue a preliminary injunction to compel Trump to block the ban.
In the appeal – which, in addition to Trump, names his communications chief, Steven Cheung, chief of staff, Susie Wiles, and Secret Service chief, Sean Curran – the news organizations assert that their journalists’ rights under the First Amendment, which protects freedom of expression and the press, and the 14th Amendment, which protects the right to due process, have been violated. Judge Tim Kelly has asked the Department of Justice to file its response by today.
Judge Kelly has previously handled a similar case when, in 2018, he ordered the White House credentials to be returned to Jim Acosta, a CNN journalist against whom Trump had then imposed a personalized ban. Not coincidentally, in a post last night on Truth Social, Trump states that “almost without a doubt we will have to appeal” against the decision that will be made by “a judge named Tim Kelly who, unfortunately, was appointed by Trump,” referring to the fact that he himself appointed the federal judge during his first term.
