Top Court Rejects Damages Suit by Children of Hiroshima Hibakusha

Tokyo, Jan. 26 (Jiji Press)–Japan’s Supreme Court has confirmed a lower court ruling in favor of the state in a damages lawsuit filed by 27 children of hibakusha atomic bomb survivors in Hiroshima. The top court’s First Petty Bench issued the decision on Thursday. In the lawsuit, the plaintiffs claimed that the exclusion of hibakusha children from the hibakusha support law was unconstitutional. In February 2023, Hiroshima District Court dismissed the lawsuit, noting that the Diet had discretion over the law’s coverage. Hiroshima High Court upheld the ruling in December 2024. In January 2025, the top court rejected a similar lawsuit filed by children of hibakusha in Nagasaki. END [Copyright The Jiji Press, Ltd.]
