Slovakia, EU: ‘constitutional amendment? European law has primacy’

(Adnkronos) – “I recall that EU law has primacy over national law, including constitutional provisions and fundamental law.” This was stated by Markus Lammert, spokesperson for the EU Commission, during the daily press briefing, referring to the amendment to the Slovak Constitution adopted by the Bratislava Parliament which recognizes the existence of only two sexes, makes it almost impossible for anyone who is not a married couple to adopt children, and claims sovereignty in matters of “national identity,” particularly regarding “fundamental cultural and ethical issues.” The Constitution had already defined marriage as “a unique union between a man and a woman.” 

Taking note of the measure, now under consideration by the Slovak presidency, Lammert highlights that the EU executive “has initiated an intense dialogue with the Slovak authorities” on the matter and expressed “concerns regarding how the proposed amendments to Article 7 of the Constitution relate to EU law.” Consequently, “we regret that the adoption of the text did not take into account the concerns raised by the Commission,” says the spokesperson, emphasizing that the Venice Commission was also consulted on the matter and recently issued an opinion raising similar concerns.
