(Adnkronos) – A federal judge in Maryland today issued a new ruling to block Donald Trump’s order to deny birthright citizenship, the American jus soli, to children born in the United States to undocumented migrants or those with temporary residence permits. Judge Deborah L. Boardman’s ruling is broader, applying nationwide, and permanent than the similar one issued on January 23, valid for only two weeks, by another federal judge in Seattle.
“The executive order is inconsistent with the 14th Amendment, with 125 years of Supreme Court precedent and with our nation’s 250-year history” founded on the right to birthright citizenship, wrote the Maryland judge, who said the Supreme Court has in the past rejected the narrow interpretation of the 14th Amendment given by Trump.
“No court in this country has ever upheld the president’s interpretation, and this will not be the first,” she concluded, granting the appeal of five pregnant women who are undocumented in the U.S. and two associations that protect the rights of migrants. The judge justified suspending the order’s entry into force nationwide on the grounds that one of these associations has members in every state, including hundreds of women who will give birth in the coming weeks to children who are being guaranteed the right to be U.S. citizens.
